Holm Ltd (trading as Giraffe) Terms and Conditions

Welcome to the Holm Ltd (trading as Giraffe) Website (the "Website"). These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Holm Ltd (trading as Giraffe) based at Station House, North Street, Havant, Hampshire PO9 1QU. “We/Us” make available to you the Website together with the service (the "Holm Ltd (trading as Giraffe) Service") to allow you to purchase certain products (the "Holm Ltd (trading as Giraffe) Products").
By completing an order you agree to be bound by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions do not proceed with your online order and call us to arrange for an order form to be sent to you so you can complete your purchase.

Postage and packing for UK delivery is free for orders totalling £85.00 or over. Orders under £85.00 are charged at the standard P&P rate of £4.00.

1. HOLM LTD (TRADING AS GIRAFFE) SERVICE
1.1 We own, operate and make available the Website and the Holm Ltd (trading as Giraffe) Service and we require you to register with us before ordering any Holm Ltd (trading as Giraffe) Product(s) via the Holm Ltd (trading as Giraffe) Service.
1.2 You agree to provide us with accurate and complete personal details and other information about yourself and you agree to notify us immediately of any changes which are relevant to your registration at the following e-mail address: info@giraffe-shop.co.uk.

2. ORDERING
2.1 All orders of Holm Ltd (trading as Giraffe) Products are subject to availability and acceptance by us. We will contact you in the event that any Holm Ltd (trading as Giraffe) Product(s) you have ordered are unavailable. You will have the option either to wait until the Holm Ltd (trading as Giraffe) Product(s) in question are available from stock or to cancel your order.
2.2 In the event that we are unable to supply the Holm Ltd (trading as Giraffe) Products you have ordered and you have therefore decided to cancel the order we will reimburse your payment in full.
2.3 You may submit an order by clicking on the Holm Ltd (trading as Giraffe) product you wish to purchase. You will then be asked for the size of product you require and any personalisation details you wish to have embroidered on the product. This will take you to an on-line order page which will provide further information about the ordering process generally.
2.4 You will be given clear instructions to follow that will navigate you through the order form and you shall be required to provide us with the complete personal details, including accurate postcode, of the intended recipient and all necessary payment details. We accept payment by all major credit and debit cards.
2.5 Please complete all the boxes on the order form. The boxes marked in with an asterisk are mandatory. This is to ensure that we have all the necessary information to make a successful delivery.
2.6 If you wish to have your Holm Ltd (trading as Giraffe) Product(s) personalised or are purchasing as part of an affiliated group please select from the relevant menu bars in the customisation section of the order page. You may also fill out the personal customisation section on the order page if you wish to have your Holm Ltd (trading as Giraffe) Products customised with a name.
2.7 You agree and acknowledge to check your Order before submitting it and in particular to check that the details of any customisation of Holm Ltd (trading as Giraffe) Products, including the spelling of any personal customisation requested by you, is correct.
2.8 Once you have completed the order form click on the button marked "Next" on the Order Confirmation page. The final screen confirms your order number. As soon we receive your order we will send you an e-mail confirming your order details and advising you that your order is being processed.
2.9 Once the order has been fully processed and we have confirmed the availability of the selected Holm Ltd (trading as Giraffe) Product(s) and verified your payment details, we will send you a further e-mail as confirmation of our acceptance of your order (the "Confirmation E-mail"). The Confirmation E-mail will also contain a copy of these Terms and Conditions and we advise that you print off and retain a copy of the Confirmation E mail.
2.10 Orders cannot be accepted from customers under the age of eighteen (18) years.

3. PRICES
3.1 All prices and offers quoted are inclusive of VAT (where applicable) and delivery charges in the UK and remain valid as advertised from time to time.

4. DELIVERY
4.1 The cost of delivery of Holm Ltd (trading as Giraffe) Products is additional to the price of the product. Please see delivery charges for UK, Europe and The Rest of the World. These prices are for up to five Holm Ltd (trading as Giraffe) products. If you require more than this number please email info@giraffe-shop.co.uk for a quote.
4.2 Incorrect delivery details may lead to delays in the delivery of your Holm Ltd (trading as Giraffe) Product(s), so before placing your order, please ensure that you have included the full address details, including accurate postcode, of the intended recipient and your daytime contact telephone number in the event that any delivery problems are encountered.

5. RETURNS AND CANCELLATION
5.1 Orders for Holm Ltd (trading as Giraffe) Products that have not been personalised or customised may be amended or cancelled at any time up to 14 working days beginning on the day after you have received the relevant Holm Ltd (trading as Giraffe) Products (the "Cancellation Period").
5.2 You acknowledge and agree that orders for Holm Ltd (trading as Giraffe) Products that you have asked us to personalise or customise cannot be amended or cancelled after the order has been placed and the Cancellation Period in Clause 6.1 shall not apply.
5.3 Any Holm Ltd (trading as Giraffe) Products you return to us during the Cancellation Period must be in new, unused and unworn condition with all the original packaging and garment tags still attached.
5.4 All Holm Ltd (trading as Giraffe) Products that you wish to return should be returned to Giraffe Returns, Unit 6 & 7, Braxells Farm, Winchester Road, Botley, SO32 2BX with the returns paperwork enclosed.
5.5 Any Holm Ltd (trading as Giraffe) non personalised or customised products cancelled by you should be returned within 14 days of the date of your notice of cancellation.
5.6 We will credit the original purchaser's credit card excluding taxes, duties and delivery costs within 30 days from the date of notice of cancellation.
5.7 Products sold at offer prices in the Holm Ltd (trading as Giraffe) Sale can be returned for an exchange or credit note at any time within 14 days of purchase provided they are unused and in their original packaging. Full price products sold with sale items can be returned for a full refund within 14 days provided they are unused and in their original packaging.

7. DISCLAIMER
7.1 Whilst we agree to use our reasonable endeavours to ensure that the Website and/or the Holm Ltd (trading as Giraffe) Service is fully operational and error-free we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and/or the Holm Ltd (trading as Giraffe) Service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website and/or the Holm Ltd (trading as Giraffe) Service impossible or impractical.
7.2 We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the Holm Ltd (trading as Giraffe) Products or your use or inability to access the Website and/or the Holm Ltd (trading as Giraffe) Service. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the Holm Ltd (trading as Giraffe) Products supplied.

8. GENERAL
8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website and/or the Holm Ltd (trading as Giraffe) Service from time to time. Any changes will be posted on the Website and it is your responsibility as a customer to review any changes on accessing the Holm Ltd (trading as Giraffe) Service. Changes will be effective five (5) hours after the posting of any such change.
8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website and/or the Holm Ltd (trading as Giraffe) Services for any reason at any time.
8.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions are held to be invalid or enforceable, the remaining provisions shall remain in full force and effect.
8.4 No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
8.5 If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms and Conditions.
8.6 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.
8.7 These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
